New Process for the Spousal Sponsorship Immigration Program

One of the most reliable family reunification pathways to Canadian permanent residency is the Spousal or Common-Law Partner Sponsorship program. Individuals meeting the requirements below can sponsor their legal spouse or common-law partner through this program. The person intending to marry or already married and wishing to bring their spouse/partner to Canada acts as the sponsor, while the spouse/partner is the sponsored person. Both must meet the necessary conditions.

Requirements for the Sponsor

The sponsor can include the legal spouse or common-law partner, along with dependent children. The sponsor must meet the following:

  • Be at least 18 years old.
  • Be a Canadian permanent resident (PR card holder).
  • If the sponsor is a Canadian citizen living outside Canada: Must provide proof of intent to reside in Canada with the sponsored person upon approval (e.g., job offer, lease, property sale).
  • If the sponsor is a PR holder: Must live in Canada and be resident at the time of application.
  • Must prove financial capability to support the spouse and not rely on social assistance (except for disability).
  • Must be able to meet the basic needs (food, shelter, clothing, non-public healthcare) of the sponsored person in the future.

Requirements for the Sponsored Person

The sponsored person can be a legal spouse or common-law partner of the sponsor and must meet the following:

As a Legal Spouse

  • Be at least 18 years old.
  • Be legally and officially married to the sponsor (with a valid marriage certificate).

As a Common-Law Partner

  • Not legally married to the sponsor.
  • Can be same-sex or opposite-sex.
  • Be at least 18 years old.
  • Have lived together continuously for at least 12 months under the same roof.
